Remember that dastardly villian Dan Alger, the Amish farmer who was foisting his unpasteurized milk on a helpless and unsuspecting public (horrors!), and worse yet, had the temerity to do it across state lines?  I wrote an email to the FDA complaining about the time and money they spent in this year long sting, as has been mentioned elsewhere.  They have kindly replied.  Their response is below.

Dear Sir:


Thank you for writing to the FDA to express your views concerning the agency's recent enforcement action against Rainbow Acres Farm in Kinzers, Pennsylvania.

In taking this action, FDA was fulfilling its mandate under federal law passed by Congress which prohibits the sale of unpasteurized milk in U.S. commerce. This decades-old prohibition is based on many well-documented cases of disease transmitted to consumers by unpasteurized milk.
Following an inspection of Rainbow Acres Farm last year investigators determined the farm was producing, packaging, selling, and distributing unpasteurized and unlabeled milk for human consumption in interstate commerce. On April 20, 2010, FDA issued a Warning Letter to the firm informing it of the violations and stating that regulatory action might be taken. The firm continued to operate in violation of federal law.
In this case, the firm chose to continue to distribute unpasteurized milk for human consumption in interstate commerce even after it was informed that it was violating federal law. The agency then determined that the enforcement action was necessary to protect the public health. Again, thank you for sharing your concerns with the FDA.

May I encourage everyone to get their reps to support HR 1830 which will remove the current law restricting the interstate commerce of raw milk?  Please email or call your Congress Critters.

What do you think about the idea of a state taking back federal lands from DC via the use of eminent domain?  Utah (which is 60% federal land) is trying to take back some federal land which lies atop various rich mineral deposits and get it developed.

I would be very interested in seeing what my fellow C4Ler's think about this particular state's right issue.  Check out this article about Utah's effort.

I have never understood why the feds need to own millions of miles of American land. Besides D.C. and a few military bases, American land should be held privately. But I guess they own our incomes, and our lives, and our estates when we die, so I guess it's ok for them own our land too.
