Whereas: Brian Aitken was sentenced to seven in years in State's Prison and remains in custody for carrying in a motor vehicle unloaded guns in a locked container which were not readily accessible to him.

Whereas: Such firearms were lawfully purchased and owned by him, and

Whereas: Mr. Aitken was not disqualified from possessing firearms under federal or state law and he had just moved to New Jersey and made every reasonable attempt to follow and honor of New Jersey's convoluted gun laws, and

Whereas: Former Judge James Morely did not allow the jury to consider the exemptions to New Jersey's firearm laws by which legal mechanism virtually all persons lawfully possess firearms in New Jersey , and

Whereas: The citizens of New Jersey should not be paying to incarcerate this citizen (which would be nearly $250,000) who committed no crime against person or property.

Whereas: Mr. Aitken should have never been arrested because he committed no crime and should have never have had his car searched.

Therefore we ask that Brian Aitken be granted executive clemency and his sentence be commuted.
Further be it resolved: We ask that New Jersey's firearm laws be reformed, especially in light of the recent US Supreme Court decisions of Heller and McDonald upholding the individual's right to keep and bear arms.
