Illinois Must Protect Her Citizens From Fed Overreaching

Amend HB6842
HB6842 - a bill introduced by Illinois State Representative Bill Mitchell - would release Illinois citizens from the recently passed Federal Mandate requiring all U.S. citizens to maintain government approved health care insurance.
While the state would be resisting yet another unfunded federal mandate with HB6842, the law must provide for the protection of Illinois citizens that may be held in contempt by the agencies charged with enforcing this mandate.
Our petition calls on Representative Mitchell to amend HB6842 to include a requirement that the state must defend Illinois citizens should the federal government come knocking. Without such an amendment, HB6842 is merely a statement in protest of an overreaching federal government, as any Illinois citizen that may choose to opt out of the system is doing so at their own risk. While we could certainly cite state law as a defense in court, the onus of such an action would be borne by the individual, with no assistance by the state.

Petition to Representative Bill Mitchell to Amend HB6842
Whereas: The Tenth Amendment of the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.": and
Whereas: The Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more: and
Whereas: The scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states: and
Whereas: The recently passed Mandatory Health Insurance bill grossly oversteps the powers granted to the United States by the Constitution: and
Whereas: HB6842 does not require that the Sovereign State of Illinois defend her citizens from any federal entity who may penalize them for not purchasing Health Insurance:
Therefore, be it resolved that we, the undersigned urge you to amend HB6842 to include a requirement that the State of Illinois vigorously defend her citizens from any federal entity who may penalize them for not purchasing Health Insurance.
