The trial court in a case involving the Republican Party of Los Angeles County ("RPLAC") entered a ruling in the action on May 26, 2010. The case involves a dispute between two competing officer groups, each of which contends that it is the valid and legitimate RPLAC Executive Board. The trial court dismissed the action filed by an officer group headed by plaintiff Robert W. Vaughn, deciding in favor of the competing group headed by defendant Jane Barnett. Mr. Vaughn and his fellow plaintiffs will respectfully abide by the court's ruling, but (also respectfully) they very much disagree with the court's analysis and conclusions. Here is some background about the matters which gave rise to the action.

 

The events and circumstances involved in the case entitled Republican Party of Los Angeles County; Robert W. Vaughn, et al v. Jane Barnett, et al (LASC No. BC 427334) raise core questions about proper and legitimate governance of a political party in California. Every two years, Republican Party voters in Los Angeles County elect individual members to serve as their RPLAC representatives in the county Central Committee. RPLAC itself is entirely a creation of California law, and its internal operations and affairs are specifically governed and defined by legislative enactments set forth in the California Elections Code. During the bi--annual June primary elections, seven Central Committee members are elected to represent each Assembly District in Los Angeles county, a total of 26 Assembly Districts in all. The freshly elected RPLAC members-- approximately 182 in number-- hold their "organizational first meeting" in December of the bi--annual election year (or the following January), and the members then serve their two year terms commencing on the date of the first meeting. All of this is set forth by statute in California Elections Code sections 7440-- 7444.

 

Elections Code section 7441 specifically provides that the freshly elected members are to select their Chairman and Executive Board officers at the organizational first meeting. This time and place for selection of officers is not optional or subject to whim and change by the members-- the law requires that officer selection occur at the first meeting. As a result, all members know and understand from the Elections Code itself that selection of officers at the first meeting is the initial step to be taken when they come forward to fulfill their duties and responsibilities on behalf of RPLAC.

 

The most recent "first meeting" of RPLAC took place on December 6, 2008, and the selection of valid officers for the 2009--2010 term of office occurred on that date. A sizable number of brand new members were present at the December 6 meeting, and a slate of relative newcomers stepped forward as candidates for Executive Board positions. The "newcomer" slate was headed by Glen Forsch, running for Chairman, and the group included candidates Lydia Gutierrez as First Vice Chair; Robert Vaughn as Second Vice Chair; Gary Aminoff as Treasurer; Roger Eshleman as Secretary; Constance Ruffley as Assistant Secretary; and Gwen Patrick as Assistant Treasurer. There was a competing officer slate on December 6, 2008-- headed by "old guard" candidates Linda Boyd (seeking her third consecutive term as Chairman) and Jane Barnett (running as a candidate for First Vice Chair). So far so good-- the presence of multiple officer slates is a healthy sign for the organization itself.

 

For awhile, everything seemed to be going along normally at the December 6, 2008 meeting. The two officer slates put forth their names for consideration, and the meeting was moving forward to the officer selection process itself. But the "old guard" slate headed by Linda Boyd and Jane Barnett was soon to receive a major surprise. The fresh membership, it turned out, didn't want the same RPLAC leaders to serve yet another term, and the "old guard" officers were destined to be replaced. The "newcomer" slate was favored by the majority of voters at the statutory first meeting, and change was in the air.

 

The vote for change came when outgoing Chairman Linda Boyd turned the meeting to the business of electing a Temporary Chairman. Ms. Boyd nominated Bob Huff for the role, and Glen Forsch nominated Al Han. The election of a Temporary Chairman was a face off between Ms. Boyd and Mr. Forsch, and here is the verbatim report from the minutes of the December 6, 2008 meeting about how the Temporary Chairman election process actually occurred that day:

 

"Linda Boyd [in her role as outgoing Chairman] asked for a voice vote. The vote was close and Linda Boyd declared Bob Huff the Temporary Chairperson. Glen Forsch objected and requested a standing vote; a standing vote was conducted and the results were Bob Huff (39 votes), Al Han (65 votes). Al Han was elected Temporary Chairperson."

 

Uh oh. All of a sudden some pesky newcomers were standing up and making their votes count at the statutory first meeting-- so what did Linda Boyd and Jane Barnett do in response? Well . . . once the election for a Temporary Chairman showed that the "old guard" slate wasn't going to win, Ms. Boyd withdrew her name as a candidate for Chair and Jane Barnett withdrew her name as a candidate for First Vice Chair. These two then walked out of the December 6, 2008 meeting, with their supporters in tow. The Forsch slate was then elected to office, precisely as called for in Elections Code section 7441. Here are the exact words of the statute:

 

"Elections Code 7441. (a) At the first meeting, a committee [RPLAC] shall organize by selecting a chairperson, a secretary, and any other officers and committees as it deems necessary for carrying on the affairs of this party. (b) The members of the central committee shall assume office and hold their first meeting during the month of December or January following a general election. A member shall hold office for a two year term commencing with that first meeting held in December or January following a general election."

 

The mandate of California law couldn't be clearer. From and after December 6, 2008, Mr. Forsch and his newcomer slate (including Robert Vaughn, Roger Eshleman and Constance Ruffley, all of whom are individual plaintiffs in the RPLAC v. Barnett lawsuit) were the validly and legitimately elected RPLAC officers for the 2009--2010 term.

 

The newly elected officers took up their positions and began the process of fulfilling their duties and responsibilities. Gary Aminoff, a defendant in RPLAC v. Barnett, was the elected Treasurer on the new Executive Board, and he initially tried to assure the unhappy old guarders that the new team wanted to work with them for the good of the Republican Party. But the old guarders stood apart, they stayed on the sidelines; and little did Glen Forsch and his Executive Board know that Mr. Aminoff and Jane Barnett would soon be organizing a takeover effort of RPLAC in conjunction with a group of representatives from the California state Republican Party.

 

A few words are in order about involvement on the part of the state Republican Party in the RPLAC takeover. The Elections Code is entirely clear that the state Republican Party is to be structured, organized and managed separate and apart from county party entities such as RPLAC. The Elections Code calls for RPLAC and the other local parties to be autonomous, and the state Republican Party has no right, power or jurisdiction to interfere in the internal affairs, officer selection and organization of RPLAC. Jane Barnett and her colleagues have had the backing of the state Republican Party as a core grounding for their claim of legitimacy as RPLAC officers, but under applicable law the involvement by the state Party in the RPLAC officer selection process turns the "local autonomy" framework of the Elections Code entirely on its head.

 

The takeover of RPLAC offices occurred on May 14, 2009, and the leading parliamentarian expert in the country has concluded that the actions of Jane Barnett and her colleagues were invalid and illegitimate every step of the way. There was no notice given to members that officers would be displaced that night; there was no bringing of charges against the "newcomer" Board; no statement of "cause" for removal; no opportunity to be heard; no valid vote of the full membership; there was . . . nothing. The takeover action by Ms. Barnett and her group occurred without written notice to the RPLAC members, and the expert parliamentarian retained by Robert Vaughn and his group concluded that none of the provisions of the RPLAC Bylaws and Robert's Rules of Order for removal of officers were complied with. As a result, the plaintiffs in RPLAC v. Barnett contended in their action that the conduct of the takeover participants violated the longstanding common law doctrine of fair procedure and the requirements of the Elections Code.

 

The issue before the trial court on May 26, 2010 was how the Court should properly respond when the rules and regulations adopted by RPLAC which govern removal of officers and meeting notice are "trampled" (the word of plainitffs' expert witness) by a segment of the membership. Plaintiffs asked that the Court protect the rights of the wrongfully displaced officers (and RPLAC itself), and that the Court enter a preliminary injunction against the takeover participants to restrain them from continuing to hold themselves out as RPLAC officers. The Court ruled otherwise.

 

Under the Court's ruling, Jane Barnett and her Executive Board will be the RPLAC officer group on a going forward basis for the remainder of the 2009--2010 term. But is that really the correct outcome for the Republican Party of Los Angeles County? The individual plaintiffs in RPLAC v. Jane Barnett don't think so.

This effort starts tomorrow, Thursday November 4, and continues every day for as long as it takes to recount some 50,000 Absentee Ballots; at the Registrar of Voters offices in Santa Clara County, Alameda County, San Joaquin County, and Contra Costa County. You will watch the workers to insure that fraud does not take place.

We need ten people at the San Joaquin County office and ten at the Contra Costa County office. The San Joaquin County recount effort does not start until next Monday, November 8.

As if Senator Chris Dodd's (D-CT) Fed Empowerment Act weren't bad enough to go out on, he has vowed to pass S. 1619, his "Livable Communities Act," before he quits the Senate this year.

This bill, better called the Dodd Homeowner Control Act, was snuck through committee on August 3rd, and a final Senate vote could come as early as next week!

Nancy Pelosi has the votes to pass it in the House, and Barack Obama is sure to sign it.

I don't know about you, but I have no interest in participating with Chris Dodd, Barack Obama, and their radical environmentalist friends in their version of Extreme Home Makeover.

The Dodd Bill, in the spirit of the U.N.'s "Agenda 21," focuses on "sustainable development" and "comprehensive regional plans."

These are code words for government determining not only how you live in your own home, but deciding what your neighborhood looks like by using your tax dollars to bribe state and local governments into forcing your community to fit federal guidelines.

There is not a minute to lose. A Senate filibuster is the only chance to stop this U.N. power grab.

Under the guise of "sustainability" the Dodd Homeowner Control Act will create a massive new Office of Sustainable Housing and Communities, likely to be under the control of a "Development Czar."

Such a Czar would be tasked with imposing federal standards on energy, zoning, and housing that line up with the U.N.'s radical environmental agenda.

State and local laws and zoning would be wiped out.

It's vital that sign the petition to your Senators demanding they oppose the Dodd Homeowner Control Act (aka Dodd's Livable Communities Act, S. 1619).

After you have signed your petition, I hope will you take some time to call Senate Minority Leader Mitch McConnell at 202-224-2541 and/or email him and insist the Republican caucus filibuster this globalist power grab.

Please also call Senator John Thune, Chairman of the Republican Policy Committee, at 202-224-2321 and/or email him to demand the Republican caucus adopt opposition to this agenda as its official policy on the Dodd Homeowner Control Act or any similiar future attempts.

Finally, please chip in a contribution of $10, $25, $50 - or whatever you can afford - so Campaign for Liberty can launch a grassroots mobilization effort to defeat the Livable Communities Act.

Senator Dodd will tell you his legislation is "voluntary."

But federal domination of your hometown will come in the form of federal grants.

As we saw with the so-called "stimulus package," local governments will almost always buckle to pressure to take government money.

Or else radical green activists will convince residents their elected officials are costing them millions of dollars that are owed to their community.

Once the funds are taken, if you don't have the right type of roof or windows on your house, or if your home is not powered by an acceptable form of energy, busybody federal bureaucrats will soon be on the scene.

You could be forced to spend thousands of dollars on "home improvement" to bring your home into compliance with the globalists' extreme agenda.

Frankly, without your help, I expect the Dodd Bill to pass.

Make no mistake, this legislation is all about redistribution of wealth, restricting land use and forcing a U.N. inspired one-size-fits all, one world agenda on all of us.

Our way of life has never been "good enough" for the U.N. and the globalist toadies in our own government.

They think we have too much wealth, use too much energy and take up too much space.

Their response is to chop us down to size by "spreading the wealth around," along with restricting the size and type of the houses we live in and the amount of land available to us for development.

You see, a crucial aspect of this legislation is its "Smart Growth" mandates.

Smart growth, a common term in urban planning for restricting "suburban sprawl" through open space preservation and heavy investments in mass transit, means large tracts of land are made unavailable for development.

We would be forced to be squished like sardines into the remaining (smaller) tracts of land the elites deem fit for us.

Your community will be under the thumb of un-elected boards, regional councils and governments who will decide where you live and how you live.

That is why it is vital you sign the petition to your senators demanding they defeat the Dodd Homeowner Control Act!

And then please call Senate Minority Leader Mitch McConnell at 202-224-2541 and/or email him and insist he organize the Republican caucus to filibuster this globalist power grab.

Defeating this Act will be a true test of which politicians are true champions of individual sovereignty and which ones kowtow to the globalist elites.

And while this legislation has progressed to the Senate floor, we can still beat it.

Previously, statist power grabs such as the DISCLOSE Act and Cap and Tax have ground to a halt because you signed petitions and called and emailed your senators.

While right now we are the only line of defense between our communities, Chris Dodd, and a U.N.-type one-size-fits all plan, a group of dedicated, liberty-loving Americans can make a difference.

I see it every day.

That is why it is crucial you sign the petition to your senators demanding they defeat the Dodd Homeowner Control Act!

Unless you act, Obama's bureaucrats, armed with their U.N. environmental agenda-inspired checklist, will be pouring over every roof shingle, window pane and appliance in your house.

You will lose control over the size of your home and where you can live as you are shoehorned into a federally-approved living area.

Your wealth will be "spread around" to finance this maneuver in the form of taxpayer-funded grants.

We can defeat the Dodd Homeowner Control Act (officially known as the pleasant sounding "Livable Communities Act"). But we must take action today to prevent further destruction of our Republic at the hands of reckless politicians.
