Andrew Napolitano: Health Care Bill Will Destroy American Liberty
The great judge writes at FoxNews.com about the bipartsian attack on health freedom:
Congress recognizes no limits on its power. It doesn't care about the Constitution, it doesn't care about your inalienable rights. If this health care bill becomes law, America, life as you have known it, freedom as you have exercised it and privacy as you have enjoyed it will cease to be.
Tomorrow, the House of Representatives will vote on a 2,000 page bill to give the federal government the power to micromanage the health care of every single American. The bill will no doubt pass. It will raise your taxes, steal your freedom, invade your privacy, and ration your health care. Even the Republicans have introduced their version of Obamacare Lite. It, too, if passed, will compel employers to provide coverage, bribe the states to change their court rules, and tell insurance companies whom to insure.

David S Shelby Twp, MI | Congress doesn't care about the constitution because the people don't care about it. If they did we would have 535 Ron Pauls in congress.
Isn't there some way of suing congressmen who vote for unconstitutional bills? I think the TARP bill would be an ideal candidate for such a suit. There is clearly no constitutional basis for government to take $700 billion from the taxpayers and give it to the crooked bankers who caused our current financial mess. We the people have been robbed of $700 billion and the congress did it. And they violated their oath of office in doing so. Why can't we sue them each personally for our loss? |

Orville Brettman Huntley, IL | I think it's time to realize that the Country is too far gone to be saved by law suits or rallies. It is I believe time to consider what additional measures may be necessary.

WillB852 Winter Garden, FL | I really wish Fox would give the Judge his own show; not that Freedom Watch isn't a great show, but I hate having to find it on youtube. |

 mcapanelli Nesconset, NY | @David,
I ran this by a civil lawyer friend of mine and believe it or not, there is! We could take up a class action suit against the house and senate, all the way up the the President, that states they've violated their oaths to uphold the Constitution and should step down or be charged under the founding documents of the country with treason. The problem is getting a lawyer to take on the case. Add to that you'd never win as it'd get thrown out of court, at least according to my friend. He's a Conservative (Surprisingly) so I thought I could sell him on it. I'm still going to try though. |

LawyerLynn Overland Park, KS | @ mcapanelli: why do we need a class action suit? if we have standing to sue as a class, we would also have standing individually (I think). Then, do we need a lawyer?
You Don't Always Need a Lawyer!
I'm a lawyer but my license is inactive. If someone will work with me in providing the research help, & on figuring out how to draft & file the pleadings (documents to file, opening up the case), and then outline the case process, procedures & plan, then we can make them available, with instructions, for people, for free, to file & conduct their cases by themselves, or even with hired and/or donated legal help.
People Can Learn About the Law & D.I.Y.
If you know what to do in court, and you do the paperwork correctly, then you're not required by law to have a lawyer, at least that I know of. In Missouri, the state Supreme Court ordered the lawyers to help build the forms people would need for a divorce, now those are available for people, for free.
Just Imagine 110,000 (or More) Lawsuits for the Various Claims!
If even 1/2 of the C4L members filed suit, that would be 110,000 lawsuits. What about incarcerated people? I'm sure there's plenty of claims there, and they're usually pretty good at self-directed legal cases, and prisons have the best law libraries in the country.
