Victory! State sovereignty resolution passes

About a month ago, a coalition of liberty advocates descended onto Lansing Michigan to remind our legislators of one key aspect of our US Constitution.
State Sovereignty under the 10th amendment tells the Federal Government that those powers not enumerated in the Constitution are reserved for the several states and to the people. It means if the federal government does something it ought not to, the States do not have to follow, nor can the Federal government impose upon the states that which would violate the constitutions of the several states.
Yesterday, on Constitution Day, our Michigan state senate passed 33-0 (4 not voting) SCR 004 to reaffirm Michigan's sovereignty under the 10th amendment. Thank State Senator Bruce Patterson 7th district Canton, for bringing this issue to the floor. Here is the video of his speech:

A move in the right direction perhaps, but we'll see when something important comes along that should be challenged. |

 Son Of Liberty Erie, PA | This is good news, it's a step in the right direction. However, it has no teeth and I doubt much will change. Next round, we need to hit them with something that has teeth and then when the election season comes, take 'em out! |

 darrel Lakeview, OR | The vote in the Michigan senate means nothing. The Tenth Amendment was in place before the vote and the legislature did nothing to enforce it. Same goes with the other states that have passed similar legislation; Tennessee and Oklahoma to name but two. The tenth amendment allows all of the individual states to tell the federal government that it cannot force unconstitutional mandates on them. It should not take a vote on a measure that reaffirms this.
If we truly expect the states to stop the federal government from illegal mandates, we should also have expected that they would have done it before this redundancy of a sovereignty measure or nullification or whatever you want to call it. |
